1. Definitions
- "Ho Cheung" / "We" / "Us" / "Our" — refers to Ho Cheung, 14 Tai Hang Road, Tai Hang, Hong Kong.
- "Resident" — any person who has entered into a written arrangement with Ho Cheung to receive one or more of our lifestyle services.
- "Family Member" / "User" — any person using this website or making an enquiry on behalf of a prospective or current resident.
- "Service" — one or more of the lifestyle arrangements offered by Ho Cheung, including Shared Dining & Tea House, Garden & Courtyard Mornings, and Full Comfort Residence.
- "Agreement" — the written residence arrangement entered into between Ho Cheung and a Resident or their authorised representative.
2. Acceptance of Terms
By using this website or submitting an enquiry to Ho Cheung, you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and agree to these Terms & Conditions.
Use of our services as a Resident is governed by the individual written Agreement provided before the commencement of any arrangement.
3. Service Description
Ho Cheung is a non-medical senior lifestyle residence located in Tai Hang, Hong Kong. Our services are designed for older adults who are largely independent and seek communal living support including shared dining, outdoor access and personal assistance.
We do not provide medical, nursing or clinical care. Our services are not a substitute for medical facilities and should not be relied upon as such. Residents requiring clinical care are advised to consult appropriate healthcare professionals independently.
4. User Responsibilities
Users of this website agree to:
- Provide accurate and complete information when submitting enquiries
- Refrain from using the website for any unlawful purpose
- Refrain from transmitting spam, malware or other harmful content
- Respect the privacy and wellbeing of all residents and staff
5. Intellectual Property
All content on this website — including text, images, layout and design — is the property of Ho Cheung or its licensors. You may not reproduce, distribute or create derivative works from any part of this website without our written permission. A limited, non-exclusive licence is granted to view this website for personal, non-commercial use only.
6. Payment Terms
- All fees are denominated in Hong Kong Dollars (HKD)
- Monthly fees are due on the first of each calendar month
- Accepted payment methods will be set out in the individual written Agreement
- Fees are non-refundable once a calendar month has commenced, except where Ho Cheung is in material breach of the Agreement
- Published monthly rates are subject to change with 30 days' written notice
7. Residence Arrangement Terms
- All arrangements are confirmed in a written Agreement before commencement
- Arrangements are provided on a month-to-month basis unless otherwise agreed in writing
- Changes to arrangement tier may be made at the start of any calendar month with reasonable notice
- The Full Comfort Residence arrangement includes a private furnished room; furnishings may not be removed or materially altered
- Residents are expected to treat communal spaces and other residents with courtesy and respect
8. Disclaimers
This website and its content are provided in good faith but on an "as is" basis. Ho Cheung makes no representations about the completeness, accuracy or suitability of the information contained herein for any particular purpose.
Ho Cheung does not provide medical advice. Nothing on this website should be interpreted as a health recommendation. Residents and families should consult qualified medical professionals for health-related decisions.
9. Limitation of Liability
To the fullest extent permitted by Hong Kong law, Ho Cheung shall not be liable for any indirect, incidental, or consequential loss arising from the use of this website or our services, except where such loss results from our own negligence or wilful misconduct.
Our total liability under any claim shall not exceed the amount paid by the Resident in the month to which the claim relates. Force majeure events — including natural disasters, government actions, pandemics or other circumstances beyond our reasonable control — shall suspend our obligations for the duration of the event.
10. Indemnification
You agree to indemnify and hold harmless Ho Cheung, its staff and representatives from any claims, losses or expenses arising from your breach of these Terms, your misuse of our website, or your violation of any applicable law.
11. Termination
Either party may end a residence arrangement by providing written notice as specified in the individual Agreement, typically 30 days before the end of a calendar month.
Ho Cheung reserves the right to terminate an arrangement with immediate effect where a Resident or their representative has acted in a manner that endangers the safety or wellbeing of others in the residence.
12. Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region. In the event of a dispute, we encourage parties to seek resolution through informal discussion in the first instance. Where that is not possible, disputes shall be referred to the courts of Hong Kong.
Mediation through the Hong Kong Mediation Centre may be agreed by both parties as an alternative to formal proceedings.
13. General Provisions
- Entire Agreement: These Terms, together with any individual written Agreement, constitute the entire agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining provisions shall continue in effect.
- Waiver: Failure to enforce any right under these Terms shall not constitute a waiver of that right.
- Notices: Formal notices should be sent in writing to 14 Tai Hang Road, Tai Hang, Hong Kong, or by email to [email protected].
14. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect any changes. Continued use of our website or services following an update constitutes acceptance of the revised Terms.
